1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed through the online store of gewerkdesign GmbH + Co. KG, Niedstr. 17, 12159 Berlin.
Our offer is directed at both consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business customer is a natural person, a legal entity, or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.
2. Contracting Parties and Conclusion of the Contract

The presentation of products in the online store does not constitute a legally binding offer. By submitting an order, the customer makes a binding offer to purchase the selected goods.
Upon receipt of the order, the customer will receive an automatic confirmation via email. The purchase contract is concluded as soon as we accept the order by issuing a separate order confirmation or ship the goods.
If an ordered product is unavailable, we will inform the customer immediately. In this case, any payments already made will be refunded.
3. Products and Unique Features of Upcycled Products
The cp08 tableware series offered in the online store is a mass-produced line manufactured under license by the porcelain manufacturer Seltmann Weiden. Our upcycled products, on the other hand, are one-of-a-kind items. They are crafted from various materials sourced from past exhibitions designed by gewerkdesign. Due to the diversity of the materials used and the individual variations in the textile cutouts, the individual products may differ from one another, particularly in terms of pattern, color, texture, surface, workmanship, and other characteristics. Such variations resulting from the materials and manufacturing process do not constitute a defect, provided they fall within the scope of the product description.
4. Prices and Payment
All prices listed in the online store are total prices in euros and include applicable sales tax, if any.
In addition to the product prices, shipping costs apply. The amount of the shipping costs, consisting of postage and packaging materials, is based on the total weight of the respective order and is displayed during the checkout process.
Payment may be made by credit card, Google Pay, or PayPal.
The purchase price and applicable shipping costs are due immediately upon conclusion of the contract, unless otherwise specified during the ordering process.
5. Delivery and Shipping
We currently ship exclusively within Germany.
Depending on the size and weight, shipments are handled by Deutsche Post or DHL. Shipping categories include Large Letter, Maxi Letter, and Package. Large and Maxi Letters are shipped with basic tracking. Deutsche Post’s basic tracking is a free service for standard letters featuring a QR-like matrix code on the stamp. It indicates whether the letter has been processed at the origin and destination mail centers, but does not include a precise live map or confirmation of direct delivery to the mailbox. Shipments are tracked.
Shipping costs, calculated based on weight, are displayed during the ordering process:

Delivery typically takes 3–5 business days. If there is a delay in dispatch, we will notify the customer as soon as possible.
6. Retention of Title
The goods remain the property of the seller gewerkdesign GmbH + Co. KG until full payment has been made.
7. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal.
Details regarding the right of withdrawal, how to exercise it, and the consequences of withdrawal are set forth in the separate notice of withdrawal provided in the online store.
Statutory exceptions to the right of withdrawal remain unaffected.
8. Liability for Defects
The statutory provisions regarding liability for defects apply.
In particular, with our one-of-a-kind upcycled items, material-related variations in pattern, color, texture, and surface are characteristic and may be part of the product in question. They therefore do not constitute a material defect.
The customer’s statutory rights regarding products that are actually defective remain unaffected by this.
9. Liability
We are fully liable for damages resulting from injury to life, body, or health. We are also fully liable for damages resulting from a breach of duty caused by willful misconduct or gross negligence.
In all other respects, we are liable in accordance with statutory provisions.
10. Special Provisions for Business Customers
For customers acting as business customers at the time the contract is concluded, the statutory provisions regarding the consumer’s right of withdrawal do not apply.
With respect to business customers, the statutory obligations to inspect and give notice of defects pursuant to Section 377 of the German Commercial Code (HGB) apply.
The statutory warranty and liability provisions remain unaffected in all other respects, unless a valid deviating agreement has been made in these General Terms and Conditions.
11. Governing Law
German law applies.
With respect to consumers, this choice of law applies only to the extent that it does not limit the protection afforded by mandatory provisions of the country in which the consumer has his or her habitual residence.
For business entities, the place of jurisdiction for all disputes arising from contractual relationships with gewerkdesign GmbH + Co. KG is Berlin, provided that the business entity is a merchant, a legal entity under public law, or a special fund under public law.
12. Dispute Resolution
We are generally neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
